Terms of Service

01 Acceptance of Terms

By accessing or using ELINSI's platform, website, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using ELINSI on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

If you do not agree to these Terms, you may not use our Services. These Terms apply to all users, including candidates, employers, and visitors.

02 Description of Services

ELINSI is an AI-powered hiring engine for the tech market in the United States and Canada. Our platform enables:

• Candidates to create profiles, be matched to relevant roles, and participate in automated screening processes
• Employers to post job descriptions, receive AI-ranked candidate shortlists, conduct automated screening, and receive pre-screen reports
• Both parties to communicate and progress through a hiring workflow

ELINSI is a technology platform — we facilitate connections between employers and candidates. We are not a staffing agency, employment agency, or recruiter, and we do not guarantee employment outcomes.

03 Accounts & Registration

To access ELINSI's features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and not share account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized access at security@elinsi.com

You must be at least 16 years old to create an account. By registering, you confirm you meet this requirement.

04 Candidate Terms

As a candidate using ELINSI, you agree to:

• Provide truthful and accurate information on your profile, resume, and in screening responses
• Not misrepresent your skills, experience, education, or qualifications
• Not submit automated or artificially generated responses to screening questions
• Acknowledge that your profile may be reviewed by employer accounts on the platform
• Respond to screening requests within the timeframes specified

05 Employer / Company Terms

As an employer using ELINSI, you agree to:

• Post only genuine, active job openings that comply with applicable employment laws
• Not discriminate against candidates based on protected characteristics (race, gender, age, religion, national origin, disability, etc.)
• Use candidate data only for the purposes of evaluating them for the specific posted role
• Not share candidate data with third parties outside your hiring team without consent
• Comply with all applicable privacy laws including PIPEDA (Canada) and applicable US state privacy laws
• Not use ELINSI data to build competing products or to scrape candidate information

06 Prohibited Conduct

You may not use ELINSI to:

• Post fake jobs, scam listings, or phishing content
• Harvest or scrape user data using automated tools
• Reverse-engineer, decompile, or attempt to access our AI models or source code
• Circumvent any access controls or security features
• Transmit malware, viruses, or other harmful code
• Engage in any fraudulent, deceptive, or illegal activity
• Harass, threaten, or abuse other users of the platform
• Use ELINSI to make employment decisions that violate human rights or employment law

Violations may result in immediate account termination and, where appropriate, reporting to authorities.

07 Intellectual Property

ELINSI's IP: The platform, including its design, AI models, algorithms, codebase, and content, is owned by ELINSI Inc. and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our platform or technology.

Your content: You retain ownership of the content you upload to ELINSI (resumes, job descriptions, etc.). By uploading content, you grant ELINSI a limited, non-exclusive license to use that content to provide the Services, including to train and improve our AI matching systems using aggregated, de-identified data.

Feedback: Any feedback or suggestions you provide about ELINSI may be used by us without any obligation or compensation to you.

08 Payment & Billing

Paid plans are billed monthly or annually as selected. By providing payment information, you authorize ELINSI to charge the applicable fees.

• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel at any time from your account settings — cancellation takes effect at end of billing period
• Refunds are available within 7 days of initial purchase for new subscribers
• We reserve the right to change pricing with 30 days' notice to existing subscribers
• Failed payments may result in service suspension after a 7-day grace period

All prices are in USD unless otherwise stated. Canadian users may see CAD pricing where applicable.

09 Disclaimers & Limitation of Liability

ELINSI's Services are provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that: the platform will be uninterrupted or error-free; AI scores or shortlists will result in successful hires; or any candidate or employer information is accurate or reliable.

10 Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, engage in fraud, or for other legitimate business reasons, with or without notice depending on severity.

Upon termination: your right to access the Services ends immediately; we will retain and delete your data per our Privacy Policy; provisions that should survive termination (including IP, disputes, liability limits) will do so.

11 Dispute Resolution

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration administered by the ADR Institute of Canada, except that either party may seek injunctive relief in court for IP infringement or data security breaches.

Before initiating arbitration, we ask that you contact us at legal@elinsi.com to attempt informal resolution — most issues can be resolved this way.

12 General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ELINSI
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force
• Waiver: Failure to enforce any right does not constitute a waiver of that right
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger or acquisition
• Updates: We may update these Terms; continued use after the effective date constitutes acceptance
